CANADA SET TO IMPLEMENT KEY CHANGES TO THE COMPREHENSIVE RANKING SYSTEM FOR THE EXPRESS ENTRY PROGRAM

The Immigration, Refugees and Citizenship Canada (IRCC) have taken a significant step towards implementing changes to the Comprehensive Ranking System (CRS) for its Express Entry Immigration system, that will see immigration to Canada through Express Entry become a lot easier. The Express Entry system manages three main federal programs, namely the Federal Skilled Worker Class, Federal Skilled Trades Class, and the Canadian Experience Class.

Published in the Canadian government’s official Gazette, the changes to the Express Entry immigration system will become effective on 19 November 2016.

Main changes to job offers include:

  1. 200 points are now offered for a qualifying job offer in an occupation contained in a Major Group 00, also known as senior management position as described in the National Occupation Classification. The occupations are:
  • 001 Legislators
  • 0012 senior government managers and officials.
  • Senior managers – financial, communications, and other business services.
  • Senior managers – health, education, social and community services and membership organizations.
  • Senior managers – trade, broadcasting, and other services.
  • Senior managers – transportation, construction, utilities and production.
  1. A regular qualifying job offer is now worth 50 points.

In the past, qualifying job offers supported by the Labour Market Impact Assessment (LMIA) were worth 600 points, under the new changes, there will be different ways for being awarded with 50 or 200 points without the need for an LMIA. Under the new regulations, the following individuals will with a qualifying job offer will be awarded points:

  • Individuals with a work permit under an international trade agreement, for example, the North American Free Trade Agreement NAFTA.
  • Those individuals with a work permit issued under the ‘significant benefits to Canada’ such as Intra-company Transfers.

For the two cases above, the individual must have been working in Canada for at least one year and the employment offer must come from the same employer as indicated on the work permit.

Canadian study is now a factor

The following points will be awarded for Canadian educational credentials:

  1. 0 points if the foreign only has a secondary school educational credential
  2. 15 points if the foreign individual has an eligible credential from a one-year or two-year post-secondary program.
  3. 30 points if the foreign individual has either :
  • An eligible credential from a post-secondary program of three years or more.
  • An eligible credential from a University level program at the master’s level of an entry-to-practice professional degree from an occupation listed in the National Occupation Classification statutes.
  • An eligible credential from a university-level program at a doctoral level.

Points will only be awarded for Canadian study experience if the foreign national:

  • Studied at a Canadian education institution.
  • Was enrolled in full-time study or training for at least eight months, and
  • Was physically present in Canada for at least eight months.

Invitation to Apply

Under the previous regulations, the Immigration, Refugees and Citizenship Canada (IRCC), candidates who received an ITA for permanent residence were required to submit their applications within 60 days. The new regulations will give candidates additional time, and they will now have 90 days to submit their applications.

Consequences for candidates

On 19 November these new regulations will automatically be implemented and the Express Entry pool being a very competitive system where candidates profiles are ranked against each other with the higher ranked candidates more likely to receive an ITA. When these regulations are implemented the value of a job offer will go down from either 600 to 200 or 50 depending on the job offered.

Principal Nominee Program (PNP) is now the most important factor

Candidates who obtained an enhanced nomination certificate through a Provincial Nominee Program (PNP) category will continue to receive 600 points. In its Immigration plans for 2017 the Canadian government has clearly stated that it aims to receive around 51,000 new immigrants through PNP’s next year, making it the most valuable immigration program and candidates must make sure they are up to date with all the changes.

Express Entry
